Terms of Service

These Terms govern your use of NAC Travel’s services and websites. We are a private consultancy and are not affiliated with any government or embassy. Government authorities decide visa outcomes; we do not guarantee visa issuance.

1. Introduction

Welcome to NAC Travel International Pty Ltd (“NAC Travel”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of our websites and services, including but not limited to visa assistance, study-abroad consultancy, holiday packages, and related travel services.

2. Definitions

  • Client/You: Any individual or entity using our services.
  • Services: Visa assistance, travel planning, bookings, consultancy, and related offerings.
  • Authorities: Government departments, consulates, embassies, border agencies, and similar bodies.
  • Third-Party Providers: Airlines, hotels, tour operators, payment processors, courier services, educational institutions, etc.

3. Acceptance of Terms

By accessing, browsing, or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms and any policies referenced herein. If you do not agree, you must cease use immediately.

4. Scope of Services

We provide professional guidance, document preparation assistance, coordination, and status support. We do not make immigration decisions, issue visas, or control third-party timelines. Service-specific inclusions/exclusions will be stated on the relevant quotation, package page, or agreement.

5. No Government Affiliation & No Guarantee of Visa Issuance

NAC Travel is a private consultancy. We are not a government agency, not affiliated with any embassy/consulate, and we do not influence visa decisions. Visa outcomes are made solely by the relevant Authorities.

Accordingly, we do not guarantee that any visa or permit will be granted, nor do we guarantee processing durations, interview availability, or appointment slots. Any timelines shared are indicative only.

6. Fees, Payments & Refunds

  • Service Fees: Our professional fees cover consultancy and support activities and are generally non-refundable once work begins.
  • Third-Party Fees: Consular, VAC, courier, biometrics, translation, or similar fees are set by third parties and are typically non-refundable.
  • Dynamic Pricing: Airfares, accommodations, and other dynamic components may change until paid and confirmed.
  • Taxes/Levies: Unless stated otherwise, applicable taxes and statutory charges are your responsibility.
  • Invoices & Payment Methods: Methods may include card, EFT, or other supported channels stated on your invoice/checkout.
  • Refund Requests: Where permitted, refunds follow the governing third-party policy and our refund policy (see Related Policies).

7. Third-Party Services

We coordinate with Third-Party Providers but do not control their actions, policies, or performance. Your bookings with those providers are subject to their terms. We are not liable for acts/omissions of such providers.

8. Client Obligations

  • Provide complete, accurate, and timely information and documents.
  • Attend biometrics/interviews where required and comply with instructions from Authorities.
  • Track communications and respond promptly to information requests.
  • Ensure passports and documents meet validity and format requirements.
  • Comply with all applicable laws and entry conditions.

9. Privacy & Data Protection (POPIA/GDPR)

We process personal data to provide Services, verify identity, prevent fraud, and meet legal obligations. We apply appropriate technical and organizational measures. Data may be transferred cross-border for processing or submission to Authorities and providers. Please review our Privacy Policy for details, including rights of access, correction, and deletion where applicable.

10. Compliance (KYC/AML, Sanctions, Anti-Bribery)

  • We may conduct KYC/AML checks and request identification to comply with law.
  • We may decline or terminate Services if providing them would breach sanctions/export control or anti-corruption laws.
  • Gifts, facilitation payments, or improper advantages are prohibited.

11. Intellectual Property & Website Use

Content, trademarks, logos, and materials are owned by us or our licensors. You may not copy, modify, or distribute content without permission. Automated scraping or misuse is prohibited.

12. Disclaimers & Limitations of Liability

To the fullest extent permitted by law, Services are provided “as is”. We disclaim all warranties not expressly stated. We are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages. Our aggregate liability for direct damages related to a Service is limited to the professional fees paid to us for that specific Service.

Nothing in these Terms excludes liability where such exclusion is not permitted by applicable law.

13. Changes, Cancellations & Force Majeure

Changes or cancellations are subject to applicable provider policies and our own terms. We are not responsible for delays or failures caused by events beyond our reasonable control (including government actions, strikes, systems outages, natural disasters, or public health events).

14. Chargebacks & Billing Disputes

If you believe there is a billing error, contact us promptly. Initiating a chargeback without first attempting to resolve the matter may delay resolution. Where work has commenced, we may contest chargebacks with evidence of delivery.

15. Governing Law & Disputes

These Terms are governed by the laws of the Republic of South Africa. Disputes should first be escalated to Support. If unresolved, the parties may pursue mediation; failing which, the courts of South Africa shall have exclusive jurisdiction.

16. Miscellaneous

  • Service-Specific Terms: Where a conflict exists, service-specific terms override these Terms for that service.
  • Updates: We may update these Terms; continued use after changes indicates acceptance.
  • Severability: Invalid provisions are severed; the remainder remains enforceable.
  • No Waiver: Failure to enforce is not a waiver.
  • Assignment: You need our consent to assign; we may assign without restriction.
  • Not Legal Advice: Our guidance is not legal advice and we are not a law firm.
  • Electronic Communications: You consent to receive notices electronically.
